Rule 11 bis of the ICTY Rules of Procedure and Evidence provides for the transfer of cases from the ICTY to the national courts for prosecution. Rule 11 bis further states that “the Prosecutor may send observers to monitor the proceedings in the national courts on her behalf”. Modalities of cooperation between the ICTY and OSCE have been agreed and OSCE BiH has established a specialised section for this purpose as part of the Mission’s Human Rights Department. This monitoring task both in first instance and on appeal is also in accordance with the Mission’s overall duty to assist the authorities of BiH to re-establish the rule of law and ensure the highest respect for human rights. The Ministry would also encourage the 11bis Section to report more general on the development of the Court and the Registry of Bosnia and Herzegovina based on the monitoring experiences. The funding should cover costs related to the Missions 11 bis Monitoring Section related to 2007 and 2008.
